615 Crawl Space provides information and facilitates connections for crawl space inspections, encapsulation, insulating, and related services (the “Services”). 615 Crawl Space itself does not perform these services. All work is performed by our partners at Frontier Basement Systems (“Partner Contractors”).

3. Third-Party Services and Disclaimer

You acknowledge and agree that the Services are performed by Partner Contractors, and not by 615 Crawl Space. 615 Crawl Space acts solely as an intermediary to connect you with Partner Contractors. 615 Crawl Space assumes no responsibility or liability for any actions, omissions, negligence, or damages caused by the Partner Contractors, including but not limited to, the quality of work performed, any property damage, or any personal injury. Any agreement for services is solely between you and the Partner Contractor. You are responsible for verifying the Partner Contractor’s licenses, insurance, and qualifications.

4. Consent to Contact

By using the Website or contacting 615 Crawl Space, you expressly consent to be contacted by 615 Crawl Space and our Partner Contractors via phone, email, or other means of communication, for purposes related to the Services, including scheduling, estimates, and follow-up.

5. Limitation of Liability

To the fullest extent permitted by applicable law, 615 Crawl Space shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to your use of the Website, the Services, or the actions of any Partner Contractor, even if 615 Crawl Space has been advised of the possibility of such damages. In no event shall 615 Crawl Space’s total liability to you for all claims arising out of or relating to these Terms or your use of the Website or the Services exceed one hundred U.S. dollars ($100).

You agree to indemnify, defend, and hold harmless 615 Crawl Space, its officers, directors, employees, agents, and affiliates, from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your use of the Website or the Services, your violation of these Terms, or your interaction with any Partner Contractor.

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions.

9. Dispute Resolution

Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Nashville, Tennessee. The decision of the arbitrator shall be final and binding on all parties.

10. Changes to Terms

615 Crawl Space reserves the right to modify or update these Terms at any time without prior notice. Your continued use of the Website or the Services after any such changes constitutes your acceptance of the revised Terms.

11. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

12. Entire Agreement

These Terms constitute the entire agreement between you and 615 Crawl Space relating to your use of the Website and the Services, and supersede all prior or contemporaneous communications and proposals, whether oral or written.
